Terms of Use

Overview

International Christian Resources grants the non-exclusive right to access and use any and all of the music compositions of the International Christian Resources copyright holders, solely for non-commercial purposes to further the life and work of the congregation throughout the term of this subscription and subject to the following conditions.

• Subscriber may not reproduce the compositions for any person(s) other than Subscriber and their parish music ministers, choir members and accompanists.
• For a license to reproduce, project, or print the compositions in a handout or bulletin for non-commercial use, Subscriber should use the online site www.onelicense.net.
• No reproduction of the compositions in any form can be sold or given away.
• No changes can be made to any words or music without written permission of the copyright holder.
• No language translations are permitted.
• No recording of the compositions allowed without the copyright holder’s prior written consent. However, recordings made of a worship service for onetime use by sick, elderly, and shut-in members of the church, school or ministerial organization holding the subscription are permitted.
• When this subscription expires, all copies of the compositions made under this subscription must be destroyed.
• These rights are not transferable to any other church, school, ministry, or company under any circumstance.

In using this subscription you agree to these terms. International Christian Resources may revoke this subscription at its sole discretion. You may not use resources produced under the subscription beyond the subscription expiration date.

Full Terms of Use

1. Acceptance of Terms

The Digital Music Subscriptions are a service of OCP and are administered by International Christian Resources, LLC. The subscriptions are subject to the following Terms of Use, which may update from time to time. The current version of the terms are available online at www.icrmusic.org/terms. International Christian Resources offers other online services which are governed by different Terms of Use.

2. Description of Service

The Digital Music Subscriptions provides the subscriber access to the content available at www.icrmusic.org. Subscriber may download the content, but may not duplicate or distribute the sheet music engravings, lyrics, or audio recordings to anyone beyond Subscriber's parish music ministers, choir members and accompanists. These materials are solely for use in the life and work of the licensed faith community.

3. Acceptable Use

Subscriber agrees not to violate any law, statute, ordinance or regulation. Subscriber also agrees not to make any fraudulent purchases on or through the International Christian Resources website(s). The contents are protected by national and international copyright laws.

The Spirit & Song All-Inclusive Digital Edition Subscription allows Subscriber the legal right to download the sheet music, lyrics, and audio recordings that are offered within the subscription service. Subscriber may not reproduce, or distribute the sheet music, lyrics, and audio recordings offered within the subscription service to anyone beyond Subscriber's parish music ministry, choir members and accompanists. Only the specific files and content identified with this particular subscription are covered by this permission; other songs and/or versions of included songs are not covered. Subscriber may use the online site www.onelicense.net to obtain a license to reproduce or distribute sheet music.

Subscriber must abide by all copyright notices, information and restrictions contained in any content accessed through this subscription. Alteration of the music and/or lyrics is not permitted without the expressed written permission of the copyright holder.

Music reproduction carries an obligation under copyright law to act responsibly and disagreement with provisions of the law is no justification for violating it. Damages for copyright infringement are substantial if willful.

4. Account Information

To use the Digital Music Subscriptions a church, school, ministerial organization or company account must be established. Subscriber agrees to (a)provide true, accurate, current and complete information about the organization and the administrative contact person (“Account Information”) and (b)maintain and promptly update the account should the information change.

5. Account Access and Security

International Christian Resources employs industry best practices to secure account information, payment details, and passwords. Users are responsible for maintaining the confidentiality of their email address, password, and credit card information when entering it in a web browser. Users are fully responsible for all activities that occur under their login (email address with password). Users are discouraged from sharing their password with anyone, including International Christian Resources personnel. Additional logins are available for free by contacting a Customer Care representative. Users agree to immediately notify International Christian Resources of any breach in security.

6. Privacy Policy

Account and personal information are subject to the International Christian Resources privacy policy. OCP and International Christian Resources agrees not to sell or disclose your personal information with any third parties.

7. Communications with Subscribers and Other Customers

International Christian Resources reserves the right to send postal and electronic mail to subscribers regarding subscription and related services.

Additionally, International Christian Resources may contact subscribers and/or users regarding participation in surveys and direct feedback on existing and prospective products. This information will be used to improve International Christian Resources’ offerings.

8. Financial Responsibility

Subscriber agrees not to assign, transfer or sublicense any rights as a subscriber to this service. Subscriber agrees to be financially responsible for all usage or activity on their account.

All subscriptions must be paid in full prior to renewal. Current online and offline payment options are identified on the International Christian Resources website.

9. Equipment

Subscriber shall be responsible for obtaining and maintaining, at its own expense, all computers and internet connectivity needed to access and use the subscription.

10. Monitoring

International Christian Resources may monitor the content and usage of the subscription. International Christian Resources may edit or remove material from the subscription and/or the website at any time.

11. Changed Terms

International Christian Resources may change or modify these Terms of Use from time to time. Such changes or additions shall be effective immediately upon posting on the website(s). Any use after such notice shall constitute acceptance of such changes.

12. Termination

Subscriber may terminate the subscription at end of the current term by contacting Customer Care prior to the expiration date. The subscription fee will not be refunded or prorated for subscriptions terminated at the Subscriber’s discretion. Upon termination, Subscriber agrees to immediately discontinue use of and destroy all physical and/or digital copies made while the subscription was in effect. International Christian Resources may, in its sole discretion, terminate or suspend a Subscriber’s access to all or part of the subscription for any reason.

13. Indemnification

Subscriber agrees to indemnify OCP, International Christian Resources, and any and all direct or indirect officers, directors, shareholders, members, trustees, partners, affiliates, employees, or agents, and hold them harmless from and against all loss, cost, liability and expense, including but not limited to, reasonable counsel fees and disbursements to the extent relating to (i) Subscriber’s unauthorized use of the content provided through the subscription, (ii) Subscriber’s gross negligence or willful misconduct, and (iii) any other action by Subscriber in breach of these terms. Subscriber agrees that OCP and International Christian Resources have the exclusive right, at their option, to conduct the defense of any claim, demand or suit covered by Subscriber’s indemnification with counsel selected by OCP or International Christian Resources.

14. Governing Laws and Jurisdiction

These Terms of Use shall be governed by and interpreted according to the laws of the State of Oregon, USA. Subscriber consents to jurisdiction in the State of Oregon, Multnomah County, shall be the venue for any action brought under these Terms of Use.
